But you should know that employees and contractors have characteristics that set them apart from each other in the eyes of the IRS. Read on to gain insight into the difference between employees and contractors and the tax implications of each.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-hiring-a-contractor-vs-employee-checklist-of-considerations\">Hiring a Contractor vs. employee checklist of considerations<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Are the following true? If so, you are likely wanting to hire an employee. (And conversely, are the following false? If so, you are likely wanting to hire an independent contractor.)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Will the worker work for an indefinite period of time for your business?\u00a0<\/li>\n\n\n\n<li>Will the worker have to follow instructions for when, where, and how to work?<\/li>\n\n\n\n<li>Will the worker perform tasks on a schedule you set?<\/li>\n\n\n\n<li>Will the worker be required to come into your physical office?\u00a0<\/li>\n\n\n\n<li>Will the worker need to use your business\u2019 equipment or supplies?\u00a0<\/li>\n\n\n\n<li>Will the worker be allowed to work anywhere else outside your own business?\u00a0<\/li>\n\n\n\n<li>Will the worker perform daily activities central to your business\u2019 operations?<\/li>\n\n\n\n<li>Will training be required?\u00a0<\/li>\n\n\n\n<li>Will you have interest in seeing how the work is performed, versus just seeing the final product?\u00a0<\/li>\n\n\n\n<li>Will the worker be paid a fixed amount on a fixed schedule?\u00a0<\/li>\n\n\n\n<li>Could the worker be fired or quit at any time without cause?\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-difference-between-employees-and-contractors-nbsp\">The difference between employees and contractors&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Worker classification&nbsp;determines if an employer must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Withhold income taxes and FICA (Social Security and Medicare) taxes from an employee\u2019s compensation<\/li>\n\n\n\n<li>Pay the employer\u2019s share of FICA taxes as well as unemployment tax on employee wages.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Here\u2019s a quick refresher on the definitions. According to the IRS:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-employee-nbsp-description\">Employee&nbsp;description<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">There are three basic areas of determining if an individual is an employee or a contractor. They are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Behavioral Control \u2013<\/strong>\u00a0Whether the business has a right to direct and control how the work is completed.<\/li>\n\n\n\n<li><strong>Financial Control \u2013<\/strong>\u00a0Whether the business pays business expenses and provides tools.<\/li>\n\n\n\n<li><strong>Relationship of the Parties \u2013<\/strong>\u00a0Whether the business offers benefits, such as insurance, vacation, or sick pay, as well as the permanent of the relationship and the nature of written contracts describing the relationship the parties intended to create.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-employee-taxes\">Employee taxes<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">If you hire an employee, you must withhold and pay in the employee\u2019s federal, state, and local taxes and the employee\u2019s share of FICA taxes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, you must cover:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Employer FICA taxes:\u00a0<\/strong>7.65% of the employee\u2019s wages.<\/li>\n\n\n\n<li><strong>Federal Unemployment Tax Act<\/strong>\u00a0(<strong>FUTA) taxes:\u00a0<\/strong>FUTA is generally 6% of each employee\u2019s first $7,000 in wages.<\/li>\n\n\n\n<li><strong>State unemployment insurance (SUI)<\/strong>, if required by your state.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Other&nbsp;costs associated with employees&nbsp;are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Benefits<\/li>\n\n\n\n<li>Worker\u2019s compensation<\/li>\n\n\n\n<li>Overtime pay<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-employee-tax-forms-nbsp-they-receive-a-w-2-for-tax-reporting\">Employee tax forms:&nbsp;They receive a W-2 for tax reporting.<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">You are responsible for completing Form W-2, Wage and Tax Statement, for each employee. Form W-2 must be submitted to the Social Security Administration and copies must be furnished to the employees by January 31 after the close of the year.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-independent-contractor-description\">Independent contractor description<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If you control or direct only the result of the work and not&nbsp;<em>how<\/em>&nbsp;the work is done, you have likely hired an independent contractor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Contractors are usually classified as self-employed individuals, which means they are responsible for paying their own taxes.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-contractor-taxes\">Contractor taxes<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">An independent contractor\u2019s earnings are subject to income and self-employment tax.
